What makes a park a 55+ community?
A park qualifies as housing for persons 55 and older when it meets 3 conditions under federal and Florida fair housing law:
| Condition | What it means |
|---|---|
| 80% occupancy | At least 80% of occupied homes have at least 1 resident aged 55 or older |
| Published intent | The park publishes and follows policies showing it operates as 55+ housing |
| Age verification | The park checks ages through reliable surveys and affidavits |
Can people under 55 live in a 55+ park?
People under 55 can live in a 55+ park when the home also houses a resident aged 55 or older, or within the 20% of homes the law does not require to have one. Each park sets its own policy inside that limit, and many parks set stricter rules, such as a minimum age for every resident.

How do 55+ parks verify age?
55+ parks verify age when a resident applies and through surveys of current homes. Parks ask for a document showing date of birth, such as a driver's licence, a birth certificate or a passport, and keep the records to show the park still meets the 80% rule.
Do Florida 55+ communities still register with the state?
No. Florida removed the requirement for 55+ communities to register with the Florida Commission on Human Relations on 1 July 2020. The 80% rule, the published policy and age verification still apply.
What fees do 55+ parks charge?
55+ parks charge the same 2 fees as other land-lease parks: monthly lot rent, $650 to $1,200 a month in local parks, and a non-refundable application fee when you apply. The guide to mobile home lot rent covers what the rent includes and how it rises.
How do you buy a home in a 55+ park?
You buy a home in a 55+ park the same way as in any land-lease park, with one added check: the park confirms your age before it approves you. Park approval also checks background, credit, verified income and past evictions; how to buy a mobile home in Florida walks through each step.
This guide explains the rules in general and is not legal advice. Each park's own documents decide its age policy.
